Financial Declaration for Restitution

In order to determine the defendant's ability to pay restitution to the victim of the defendant's crime, Utah Code Section 77-38b-203 requires a defendant to provide to the Department of Corrections or to the court a financial declaration describing his or her assets, income, and financial liabilities. The Department might recommend a restitution amount to the court, and the court will consider the financial information. The document below is the approved form required by Section 77-38b-204.
