Alternative Drug Program
What is ADP?
The Alternative Drug Program (ADP) is a program that targets the substance abusing population in the 4th District Juvenile Court. Approximately 24% of the Juvenile court's current referrals contain one or more drug and/or alcohol offenses. Most of these drug or alcohol referrals are for juveniles who do not qualify for Probation, State Supervision, or Youth Corrections, but are in need of counseling services. The ADP will provide earlier intervention and more intensive accountability and follow.-through between the court and referral agencies that has not been in place previously. The program will create liaisons between the Utah County Substance Abuse Office, treatment providers, and schools within the Court's district. It will provide the incentive for youth to attend and complete therapy in an effort to divert these individuals from becoming further involved in the Court system.
The following qualifications have been set as guidelines for the Alternative Drug Program:
- Current referral is a drug or alcohol offense
- The juvenile and his/her parents volunteer to participate
- The juvenile admits to the offense(s)
- The juvenile completes an assessment administered by Utah County Substance Abuse, and it is recommended that he/she attend counseling
What to Expect of the ADP?
The ADP is a minimum six (6) month program. During that time the individual enters a plea in abeyance agreement with the County Attorney's office. The contract outlines the agreement outlines the conditions for the successful completion of the program. This agreement binds the individual to the following expectations:
- Accountability for the completion of the assessment recommendations
- Weekly review hearings in Court
- Weekly attendance to all required sessions with treatment providers
- Submit to random drug screens, and a required $25.00 payment to the court for each positive test
- Daily attendance at school or full-time employment, if not board released from school by the school district
- Attendance to Speaker's Bureau each month
- Complete Family Characteristic Project
- Completion of all work hours
- No violations of the law while in the program
- Parents to attend Parents Informed class
Consequences for Failure to Comply with ADP
When violations occur while the individual is participating in the ADP, they are strict and sever. Non-compliance will result in the following:
- Time spent in detention
- No credit for community service hours, or additional hours can be added
- House Arrest
- Staffed for further intervention by the court
- Possible expulsion from the program
- If expelled from the program, plea is entered with statutory requirements as set forth by Utah State Law
Why Choose ADP?
In exchange for total compliance with the Alternative Drug Program, the County Attorney's office will dismiss the violation(s) to the Juvenile Court, the juvenile will receive credit for all of the community service hours, and graduate from the program.
