USB14-0804. Certification for military legal assistance lawyers. Amend. Updates the standards for military lawyers who are allowed by military and federal law to assist certain persons who can receive military legal assistance.

USB14-0805. Admission for spouse of active military stationed in Utah. New. Allows spouses of servicemen and women who are stationed in Utah to serve as practicing lawyers under certain conditions.

Rules Governing the State Bar – Comment Period Closed November 10, 2018

USB14-0806. Proposed amendments more accurately describe pro hac vice application requirements. Changes also increase the application fee to the fee equal to the annual licensing fee by paid active members of the Utah State Bar and require pro hac vice admittees to pay an annual renewal fee for each year the pro hac admitee continues to act as counsel in the cause.

Rules Governing the State Bar and Rules Governing Licensed Paralegal Practitioner – Comment Period Closed May 20, 2018

The proposed rules apply to Licensed Paralegal Practitioners. Rule 14-403 amends the membership of the MCLE Board to permit up to 2 Licensed Paralegal Practitioners to serve on the MCLE Board. Rules 15-401 through 15-417 create continuing education requirements for Licensed Paralegal Practitioners that are similar to the MCLE Rules for attorneys. The rules require 12 hours of continuing education every two years which must include three hours of ethics and professionalism. The licensed paralegal practitioner is required to use the same certification process used by attorneys at the end of the two-year cycle to certify they have attended the appropriate CLE courses.

USB14-0409 Amend. Self-study categories of accredited MCLE defined.  Proposed changes to the rule allow up to nine (9) hours of self-study CLE credit during a compliance period for lawyers who lecture on legal topics in community outreach programs.

USB14-0413 Amend. MCLE credit for qualified audio and visual presentations, webcasts, computer interactive telephonic programs, writing, lecturing’ teaching, live attendance.  Proposed changes to the rule state the hours and types of credit that are allowed for lawyers who lecture on legal topics in community outreach programs.

Rules Governing the State Bar – Comment Period Closed March 17, 2018

USB14-0701  Amend.  Changes to Rule 14-701 clear up confusion regarding the definition of “bar examination” and make the definition of practice of law consistent with the definition used in 14-802.

USB14-0807  Amend.  Changes to Rule 14-807 clarify language that has been a source of confusion for students seeking to practice under the rule.

USB14-0809  New.  This new rule will allow lawyers admitted in other jurisdictions, who have submitted an application for admission to the Utah State Bar, to practice law in Utah under supervision while awaiting admission

USB14-0413 MCLE credit for qualified audio and visual presentations, webcasts, computer interactive telephonic programs, writing, lecturing’ teaching, public service, pro bono service, live attendance.  Proposed changes to the rule state the hours and types of credit that are allowed for lawyers who lecture on legal topics in community outreach programs and for lawyers who serve on constitutionally or statutorily created public policy making bodies.

USB14-0418 MCLE Credit for Pro Bono Legal Services. Proposed new rule that allows lawyers to earn up to six (6) hours of self-study CLE credits during a compliance period for providing pro bono legal services in a case referred by a court or for an approved legal services organization as defined in Rule 14-803.

Rules Governing the State Bar – Comment Period Closed March 10, 2017

USB 14-0110 Proposed changes to 14-110 allow inactive Bar members to serve of all Bar committees.

USB 14-0405 The changes to 14-405 clarify the rule that prohibits lawyers from switching from active to inactive and then back to active again within the same year in order to avoid MCLE compliance.

USB 14-0508 Proposed changes to Rule 14-508 requires lawyers who are administratively suspended for three years or more for failure to pay license fees to reapply for re-enrollment.

USB 14-0517 Proposed changes to 14-517(f) provide that a Bar a complaint against any lawyer employed by the Bar will be reviewed by the Ethics and Discipline Committee Chair or a special prosecutor rather than by the Office of Professional Conduct.
