Rule 51. Violation of probation andcontempt by a minor.

(a)Any minor may be found in contempt of court for an act committed in thepresence of the court.

(b)Contempt proceedings for actions alleged to have been committed by a minoroutside of the presence of the court may be commenced by either of thefollowing methods:

(1) Affidavit and order to show cause.An affidavit setting forth the facts of the alleged contempt shall be filedwith the court. Based upon the affidavit, the court may execute an order toshow cause ordering the minor's parent, guardian or custodian to produce theminor in court at a date, place, and time certain. A copy of the affidavit andthe order to show cause shall be personally served upon the minor's parent,guardian or custodian if they fail to appear in response to service by mail.

(2) Petition. A separate petition maybe filed and may include an allegation of contempt or an allegation that theminor has violated a term of probation.

(c)Sanctions for contempt shall be as provided by Utah Code section 78A-6-353 and Title78B Chapter 6, Part 3, Contempt.
