Rule 32. Initiation of ungovernability and runawaycases.

(a)Proceedings involving a child alleged to be beyond control of the child?sparent, guardian or lawful custodian, or alleged to bea runaway, shall be initiated by petition.

(b) Apetition shall be accepted by the clerk only if it is filed by the Division of JuvenileJustice Services.

(c) Thepetition must allege the earnest and persistent efforts by the agency, thechild?s out of control behavior, the behavior or other condition that endangersthe child?s welfare or the welfare of others, and the actions taken which havefailed to correct the behavior. In the alternative, the allegations may be madeby affidavit accompanying the petition.
