Rule 38

Rule 38. Prosecution of adults.

(a) All cases in which the juvenile court has jurisdictionover a criminal offense committed by an adult shall be commenced by aninformation filed by the prosecuting attorney of the county where the offenseis alleged to have occurred. The information and all court proceedings shall bein accordance with the Utah Rules of Criminal Procedure, except that a juryshall consist of four persons. If a jury trial is demanded by the defendant,the court may transfer the case to a district court.

(b) The court may permit diversion of an adult criminaloffense pursuant to Utah Code Ann. § 77-2-1 et seq. upon recommendation of theprosecuting attorney.
