Rule64C. Writ of attachment.

(a)Availability. A writ of attachment isavailable to seize property in the possession or under the control of thedefendant.

(b)Grounds. In addition to the groundsrequired in Rule 64A,the grounds for a writ of attachment require all of the following:

(b)(1) that the defendant isindebted to the plaintiff;

(b)(2)(i)that the action is upon a contract or is against a defendant who is not a residentof this state or is against a foreign corporation not qualified to do businessin this state; or

(b)(2)(ii) the writ is authorizedby statute; and

(b)(3) that payment of the claimhas not been secured by a lien upon property in this state.
