Rule 4-103.? Civilcalendar management.

Intent:

To establisha procedure that allows the trial courts to manage civil case processing.

To reduce the time between case filing and disposition.

Applicability:

This ruleshall apply to the District Court.

Statement of the Rule:

(1)       Ifa default judgment has not been entered by the plaintiff within 60 days of theavailability of default, the clerk will mail written notification to the plaintiffstating that absent a showing of good cause by a date specified in thenotification, the court will dismiss the case without prejudice for lack ofprosecution.

(2)       Ifa certificate of readiness for trial has not been served and filed within 330days of the first answer, the clerk will mail written notification to theparties stating that absent a showing of good cause by a date specified in thenotification, the court will dismiss the case without prejudice for lack ofprosecution.

(3)       Ordersof dismissal entered under this rule must contain the language ?withoutprejudice.?

(4)       Anyparty may, pursuant to the Utah Rules of Civil Procedure, move to vacate adismissal entered under this rule.
