Rule14-1116. Conduct of the mediation.
(a) Scheduling the mediation. The designatedmediator shall set the time and place for the mediation and shall cause writtennotice of the mediation to be served personally or by mail on all parties tothe mediation.
(b) Right to be represented by counsel. Inthe notice of the mediation, the mediator shall inform the parties of theirright to be represented by their own legal counsel at their own cost at anystage of the mediation process. Failure to be represented by legal counsel atany stage of the mediation is a waiver of this right at that stage of themediation, although a party may use legal counsel later in the mediationprocess.
(c) Right to be assisted at mediation. Aparty may designate an individual to accompany that party to the mediation andto participate with the party in the mediation process.
(d) Procedure. The mediator may use joint orprivate caucuses during the mediation process. The process may be adjournedfrom time to time in the discretion of the mediator or at the request of theparties.
