Article 5. Lawyer Disciplineand Disability
Rule 14-501. Purpose,authority, scope and structure of lawyer disciplinary and disabilityproceedings.
(a) The purpose of lawyerdisciplinary and disability proceedings is to ensure and maintain the highstandard of professional conduct required of those who undertake the dischargeof professional responsibilities as lawyers and to protect the public and theadministration of justice from those who have demonstrated by their conductthat they are unable or unlikely to properly discharge their professionalresponsibilities.
(b) Under Article VIII, Section4 of the Constitution of Utah, the Utah Supreme Court has exclusive authoritywithin Utah to adopt and enforce rules governing the practice of law, includingadmission to practice law and the conduct and discipline of persons admitted topractice law.
(c) All disciplinaryproceedings shall be conducted in accordance with this article and Article 6,Standards for Imposing Lawyer Sanctions. Formal disciplinary and disabilityproceedings are civil in nature. These rules shall be construed so as toachieve substantial justice and fairness in disciplinary matters with dispatchand at the least expense to all concerned parties.
(d) The interests of thepublic, the courts, and the legal profession all require that disciplinaryproceedings at all levels be undertaken and construed to secure the just andspeedy resolution of every complaint.
