ARTICLE1. Advisory Committees and the Rulemaking Process.

Intent:

To establish procedures for the adoption,modification, and repeal of rules governing the practice of law, evidence,court procedures, and other matters within the authority of the Supreme Court.

Statement of Authority.

(1) Article VIII, Section 4 of the UtahConstitution provides that the Supreme Court shall adopt rules of procedure andevidence to be used in the courts of the state and shall by rule manage the appellateprocess. Section 4 further provides that the Supreme Court may authorizeretired justices and judges and judges pro tempore to perform judicial duties.Section 4 also provides that the Supreme Court shall by rule govern thepractice of law, including admission to practice law and the conduct anddiscipline of persons admitted to practice law.

(2) To assist the Supreme Court with theseresponsibilities, the Supreme Court hereby establishes a procedure for thecreation and operation of advisory committees; the adoption, repeal andamendment of rules of procedure and evidence; rules regulating judges protempore and retired judges; rules governing the practice of law and othermatters within the constitutional authority of the Supreme Court.
