Rule 9-302. Mandatoryelectronic filing.

Intent:

To provide that documents filed in criminal cases in justice courtbe filed electronically.

To provide for exceptions.

Applicability:

This rule applies in the justice court.

Statement of the Rule:

(1) Except as provided in paragraph (3), pleadings and otherpapers filed in criminal cases in justice court between July 1, 2016 andDecember 31, 2016 may be electronically filed using the electronic filer?sinterface.

(2) Except as provided in paragraph (3), pleadings and otherpapers filed in criminal cases in justice court on or after January 1, 2017shall be electronically filed using the electronic filer?s interface.

????? (2)(A) Aself-represented party who is not a lawyer may file pleadings and other papersusing any means of delivery permitted by the court.

????? (2)(B) A lawyer whoserequest for a hardship exemption from this rule has been approved by theJudicial Council may file pleadings and other papers using any means ofdelivery permitted by the court. To request an exemption, the lawyer shallsubmit a written request outlining why the exemption is necessary to theJustice Court Administrator.

(3) The electronic filer shall be an attorney of record and shalluse a unique and personal identifier that is provided by the filer?s serviceprovider.
