Rule 4-503. Mandatory electronic filing.

Intent:

To require that documents in district court civil cases be filedelectronically.

To provide for exceptions.

Applicability:

This rule applies in thedistrict court.

Statement of the Rule:

(1) Except as providedin Paragraph (2), pleadings and other papers filed in civil cases in thedistrict court on or after April 1, 2013 must be electronically filed using theelectronic filer?s interface.

 

(2)(A) Aself-represented party who is not a lawyer or licensed paralegal practitionermay file pleadings and other papers using any means of delivery permitted bythe court.

 

(2)(B) A lawyer orlicensed paralegal practitioner whose request for a hardship exemption fromthis rule has been approved by the Judicial Council may file pleadings andother papers using any means of delivery permitted by the court. To request anexemption, the lawyer or licensed paralegal practitioner must submit a written requestto the District Court Administrator outlining why the exemption is necessary.

 

(2)(C) Pleadings andother papers in probate cases may be filed using any means of deliverypermitted by the court until July 1, 2013, at which time they must beelectronically filed using the electronic filer?s interface.

 

(3) The electronic filermust be an attorney or licensed paralegal practitioner of record and must use aunique and personal identifier that is provided by the filer?s serviceprovider.
