Code of Judicial Conduct – Comment Period Closed March 14, 2021

Terminology. Adds the definition of abusive conduct and amends the definition of judicial candidate to those who are applying for judicial office.

CJC02.3. Bias, Prejudice, and Harassment. AMEND. The amendment applies abusive conduct restrictions to judges.

CJC02.11. Disqualification. AMEND. Clarifies that the restriction on hearing cases applies when the lawyer is a supervisor of the judge’s relative.

CJC02.12. Supervisory Duties. AMEND. The amendment applies abusive conduct restrictions to judge in their supervisory roles.

CJC04.1. Political and Campaign Activities of Judges and Judicial Candidates in General. AMEND. Clarifies that only certain restrictions apply to judicial candidates.

Code of Judicial Conduct – Comment Period Closed March 13, 2020

CJC03.7. Participation in Education, Religious, Charitable, Fraternal, or Civic Organizations and Activities. Amended. Amends the Code of Judicial Conduct to permit judges to directly engage in fundraising for court projects, as long as the potential donors do not regularly appear in the court the judge serves.

Code of Judicial Conduct – Comment Period Closed February 3, 2020

CJC02.11. Disqualification. Amend. The amendments will clarify that a judge is disqualified from a case in which a lawyer in the proceeding supervises or is supervised by a judge’s family member, but the disqualification requirement is eliminated if the employing entity removes the family member from the lawyer’s line of supervision.

CJA01-0205. Standing and Ad Hoc Committees. 

AMEND.  Adds a member of the Utah Indigent Defense Commission to the Utah Judicial Council’s Standing Committee on Pretrial Release and Supervision.
AMEND.  Adds a court commissioner to the Utah Judicial Council Standing Committee on Court Forms.
AMEND.  Stylistic formatting (numbering) changes to committee composition section of the rule.

CJA04-0202.02. Records Classification.  

AMEND.  Classifies abstracts of juvenile court judgments filed in district court as “private” court records.

CJA04-0508. Guidelines for Ruling on a Motion to Waive Fees.  

AMEND.  Makes the Standing Committee on Court Forms responsible to approve the motion and affidavit to waive fees forms (previously the responsibility of the Board of District or Juvenile Court Judges).

CJA Appendix I. Summary of Classification of Court Records.

AMEND.  Change classification of “Criminal Invesigations” case type from “Protected” to “Public unless otherwise ordered” for better consistency with requirements of Utah Code.

Code of Judicial Conduct

CJC Canons Amend. The Utah Supreme Court is considering wholesale changes to the Utah Code of Judicial Conduct. The changes are based on the new ABA Model Code of Judicial Conduct, which was issued in 2007. The ABA Model Code is based on the previous Model Code, but the format is different and there are many new and deleted provisions. The draft document shows the variations from the 2007 Model Code that Utah is considering.
