Rules of Civil Procedure – Effective May 1, 2024

URCP006. Time. AMEND. The amendment adds the “Juneteenth National Freedom Day” to the list of legal holidays in subparagraph (a)(6)(E).

URCP012. Defenses and objections. AMEND. The amendments reflect the need to file and serve an answer, and clarify the use of terminology in domestic relations actions.

URCP064. Writs in general. AMEND. The amendments substitute the word “file” with the word “record” as it relates to recording with the county recorder.  Other non-substantive changes to the rule were made to adhere to the Utah Supreme Court style guide for the rules.

URCP066. Receivers. AMEND. The amendments substitute the word “file” with the word “record” as it relates to recording with the county recorder.  Other non-substantive changes to the rule were made to adhere to the Utah Supreme Court style guide for the rules.

URCP069A. Seizure of property. AMEND. The amendments substitute the word “file” with the word “record” as it relates to recording with the county recorder.  Other non-substantive changes to the rule were made to adhere to the Utah Supreme Court style guide for the rules.

URCP069B. Sale of property; delivery of property. AMEND. The amendments substitute the word “file” with the word “record” as it relates to recording with the county recorder.  Other non-substantive changes to the rule were made to adhere to the Utah Supreme Court style guide for the rules.

URCP069C. Redemption of real property after sale. AMEND. The amendments substitute the word “file” with the word “record” as it relates to recording with the county recorder.  Other non-substantive changes to the rule were made to adhere to the Utah Supreme Court style guide for the rules.

URCP083. Vexatious litigants. AMEND. The amendments clarify the ability to file a notice of or petition for permission to appeal, as well as, the notice and opportunity to be heard when the court is entering orders.

Rules of Civil Procedure – Effective May 1, 2021

URCP006. Time. AMEND. The proposed amendments to Rule 6(c) acknowledge the timing issues surrounding mail service by expanding the amount of time to act from 3 days to 7.

URCP007. Pleadings allowed; motions, memoranda, hearings, orders. AMEND. The proposed amendments to Rule 7 provide that motion hearings may be held remotely, consistent with the safeguards in Rule 43(b).

URCP037. Statement of discovery issues; Sanctions; Failure to admit, to attend deposition or to preserve evidence. AMEND. The proposed amendments to Rule 37 provide that hearings on discovery issues be conducted remotely, consistent with the Rule 43(b) safeguards.

URCP043. Evidence. AMEND. Replaces repealed Code of Judicial Administration Rule 4-106. The proposed amendments provide appropriate safeguards for the use of remote hearings and bring evidentiary hearings into the rule’s purview. The amendments also adopt an oath to be used for all witness testimony.

URCP045. Subpoena. AMEND. The proposed amendments to Rule 45 provide that if an appearance is required in response to a subpoena, the subpoena must provide notice of the date, time, and place for the appearance and, if remote transmission is requested, instructions for participation and who to contact if there are technical difficulties.

Rules of Civil Procedure – Effective May 1, 2018

URCP005. Service and filing of pleadings and other papers. Amend.  Provides that the court submitting a paper to the electronic filing service provider is a valid method of service if the person being served has an electronic filing account. Also provides that certificates of service are not required for papers that are prepared and served by the court when service to all parties is made under paragraph (b)(3)(A). 

URCP006. Time. Amend. Adopts the prisoner mailbox rule, which provides that pleadings and papers filed or served by an inmate confined in an institution are timely if they are deposited in the institution’s internal mail system on or before the last day for filing. Also provides that when a party is not represented by an attorney, does not have an electronic filing account, and may or must act within a specified time after the filing of a paper, the period of time within which the party may or must act is counted from the service date and not the filing date of the paper.

URCP026.03. Subpoena. Amend. In response to recent legislative updates to Utah Code section 78B-6-810, changes the language in paragraphs (b)(2) and (c) from “occupancy hearing” to “evidentiary hearing” and removes the language “to determine occupancy” in those paragraphs. Also removes the reference to commercial tenants in paragraph (a).

URCP045. Subpoena. Amend. Makes a technical amendment in conformity with Rule 6.

Rules of Civil Procedure – Effective May 1, 2016

URCP 006. Time. Amend. Corrects references to amended rules 50 and 60.

Revision to URCP 006.

URCP 008. General rules of pleadings. Amend. Changes the phrase “contributory negligence” to “comparative fault,” in keeping with Utah Code sections 78B-5-817.

URCP 011. Signing of pleadings, motions, affidavits, and other papers; representations to court; sanctions. Amend. Recognizes the requirements of Rule 5(f) for a notarized, verified or acknowledged signature.

URCP 050. Judgment as a matter of law in a jury trial; related motion for a new trial; conditional ruling. Amend. Adopts many of the provisions of FRCP 50. Changes the name from “directed verdict” to “judgment as a matter of law.” Eliminates the requirement that the motion be renewed at the close of all evidence. Extends to 28 days after the judgment the time in which to renew the motion for judgment as a matter of law. Describes the effect of trial court rulings reversed on appeal.

URCP 052. Findings and conclusions by the court; amended findings; waiver of findings and conclusions; correction of the record; judgment on partial findings. Adopts many of the provisions of FRCP 52. Provides for judgment on partial findings, which will replace an equivalent provision in Rule 41(b). Extends to 28 days after the judgment the time in which to file a motion to amend or make additional findings.

URCP 055. Default. Amend. Requires the plaintiff to provide a verified complaint or affidavit setting forth the necessary facts to establish the amount of the claim, after deducting credits, and verifies that the amount is warranted by information in the plaintiff’s possession.

URCP 059. New trial; amendments of judgment. Amend. Adopts many of the provisions of FRCP 59. Extends to 28 days after the judgment the time in which to file a motion for new trial or a motion to amend or alter the judgment. Allows the court to grant, after notice and an opportunity to be heard, a motion for a new trial for a reason not stated in the motion.

URCP 060  Relief from judgment or order. Amend. Style changes intended to simplify and clarify the rule.

URCP 063. Disability or disqualification of a judge. Amend. Allows a second or subsequent motion to disqualify a judge if the motion is based on grounds that the party did not know of and could not have known of at the time of the earlier motion. Requires a request to submit for decision with the motion. Expressly prohibits a response from another party.

URCP 6. Time. Technical changes to conform with Rule 7.
URCP 7. Pleadings allowed, motions, memoranda, hearings, orders, objection to commissioner?s order. Removes motions to court commissioners from the scope of the rule. Establishes the maximum length of memoranda at 10 pages without leave of the court.
URCP 24. Intervention. Provides for notice to the attorney general, county attorney or municipal attorney when claiming that a statute or ordinance is unconstitutional.
URCP 62. Stay of proceedings to enforce a judgment. Clarify finality rule. This version does NOT contain the legislative amendments of HJR 16. See entry for 2004-03-02.
URCP 64D. Garnishment. Conform to statutory changes assigning collection responsibility to the Department of Workforce services.
URCP 68. Offer of judgment. Repeal and reenact. Limit liability of offeror for costs and attorney fees incurred by offeree after an offer. Establishes offeree?s responsibility for offeror?s costs.
