Ninety-day Waiting Period in Divorce Cases


Utah Code Section 30-3-18 requires that the parties wait 90 days after the date of filing a divorce petition before a divorce decree can be granted. The waiting period may be waived for extraordinary circumstances.

Waiving the 90-day waiting period

Either party may ask that the waiting period be waived by filing a motion. A Motion to Waive the 90-day Waiting Period will not be granted automatically; the moving party must show extraordinary circumstances. The other party may agree to or oppose the motion, but the judge will decide whether to waive the waiting period.
