Does the current incident include any of the following factors?

1. BODILY INJURY: Bodily injury was inflicted upon someone other than defendant as a proximate result of defendant having operated the vehicle in a negligent manner.
2. UNDER 16 PASSENGER: Defendant, regardless of defendant’s age, had a passenger under 16 years of age in the vehicle at the time of the offense.
3. YOUNG DEFENDANT & 18 PASSENGER: Defendant was 21 years of age or older, and had a passenger under 18 years of age in the vehicle at the time of the offense.
4. AUTO HOMICIDE: Defendant has been convicted of automobile homicide under Section 76-5-207 that was committed after July 1, 2001.
5. FELONY DUI: Defendant has been convicted of a felony violation of Section 41-6a-502 or a statute previously in effect in this state that would constitute a violation of Section 41-6a-502 that was committed after July 1, 2001.
6. REDUCED DUI: Defendant has been convicted for a crime described in paragraphs 4 or 5 above which judgment of conviction was reduced under Section 76-3-402 (Conviction of Lower Degree of Offense).
