In representing an incapacitated person, I found the review of fiduciary standards and restrictions on authority very helpful. However, when I drafted language for the appointment order including my client’s preferences and reciting the standards and restrictions, the proposed guardians were offended thinking it was done at the request of someone who opposed their appointment. My point is that including these standards and restrictions in appointment orders and acceptances of appointment would be a useful educational tool for courts and guardians.
