Small Claims Case Filing Location to Change September 1
All Small Claims Cases to be Filed in Justice Court
Beginning Sept. 1, 2010, individuals planning to file a small claims case will need to do so at their local city or county Justice Court. The only exception is some areas of Cache County that do not have a Justice Court. The change is occurring as a cost-saving measure in the state courts.
Presently, there is concurrent jurisdiction with the district courts and justice courts when small claims cases are filed. In a majority of counties, small claims cases are already filed exclusively in justice courts. This change will result in all small claims cases being filed in justice courts in all counties and will primarily affect counties across the Wasatch Front.
Small claims cases filed in the state’s district courts before Sept. 1, will still be heard in the district court. District court judges will continue to hear all appeals in small claims actions.
Small claims cases cover disputes that do not exceed $10,000. Any individual or business may file a small claims case and most litigants appear without an attorney. The location of the justice court in which to file a small claims case depends on the city/county where the defendant resides or the city/county in which the cause of action arose.

Information About Judges Appearing on Your Ballot
Under the Utah Constitution, judges must stand for retention election at the end of each term of office. The public has the opportunity to vote whether to retain the judge for another term. The Judicial Council certifies whether the judge is qualified for retention election based on performance evaluations. The results of individual evaluations are published in the voter information pamphlet.

Utah State Bar Seeks Volunteer Attorneys to Represent Service Members Facing Default Judgment
The Servicemembers Civil Relief Act (SCRA) provides active duty service members with protections in civil cases. In cases where service members are facing default judgment, the court must appoint an attorney to locate and contact them to determine how they'd like to proceed with their case.
The Utah State Bar seeks volunteer attorneys to provide limited representation to service members in this situation through the Service Member Attorney Volunteers (SMAV) program. Utah State Courts Expands Self-Help Center Services
The Utah State Courts has expanded the Self-Help Center services to the Sixth Judicial District. The Self-Help Center assists individuals who are representing themselves in court to better understand court processes. The Self-Help Center program was launched in December 2007 in the Second and Eighth Judicial Districts as part of a pilot project and expanded to the Seventh Judicial District in January 2009.
